DONOT USE YOUR PRODUCT UNTIL YOU HAVE READ THE TERMS OF THE WARRANTY.

IFYOU DO NOT AGREE TO THE TERMS OF THE WARRANTY, DO NOT USE THE PRODUCT ANDRETURN IT WITHIN THE RETURN PERIOD STATED IN KOLONI’S RETURN POLICY (FOUNDAT http://www.koloni.io/legal) TOTHE KOLONI OWNED RETAIL STORE OR THE AUTHORIZED DISTRIBUTOR WHERE YOU PURCHASEDIT FOR A REFUND.

 

HOW CONSUMER LAW RELATES TO THIS WARRANTY

THIS WARRANTY GIVES YOU SPECIFIC LEGALRIGHTS, AND YOU MAY HAVE OTHER RIGHTS THAT VARY FROM STATE TO STATE (OR BYCOUNTRY OR PROVINCE). OTHER THAN AS PERMITTED BY LAW, KOLONI DOES NOT EXCLUDE,LIMIT OR SUSPEND OTHER RIGHTS YOU MAY HAVE, INCLUDING THOSE THAT MAY ARISE FROMTHE NONCONFORMITY OF A SALES CONTRACT. FOR A FULL UNDERSTANDING OF YOUR RIGHTSYOU SHOULD CONSULT THE LAWS OF YOUR COUNTRY, PROVINCE OR STATE.

WARRANTY LIMITATIONS SUBJECT TO CONSUMERLAW

TO THE EXTENT PERMITTED BY LAW, THISWARRANTY AND THE REMEDIES SET FORTH ARE EXCLUSIVE AND IN LIEU OF ALL OTHERWARRANTIES, REMEDIES AND CONDITIONS, WHETHER ORAL, WRITTEN, STATUTORY, EXPRESSOR IMPLIED. KOLONI DISCLAIMS ALL STATUTORY AND IMPLIED WARRANTIES, INCLUDINGWITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULARPURPOSE AND WARRANTIES AGAINST HIDDEN OR LATENT DEFECTS, TO THE EXTENTPERMITTED BY LAW. IN SO FAR AS SUCH WARRANTIES CANNOT BE DISCLAIMED, KOLONILIMITS THE DURATION AND REMEDIES OF SUCH WARRANTIES TO THE DURATION OF THISEXPRESS WARRANTY AND, AT KOLONI'S OPTION, THE REPAIR OR REPLACEMENT SERVICESDESCRIBED BELOW. SOME STATES (COUNTRIES AND PROVINCES) DO NOT ALLOW LIMITATIONSON HOW LONG AN IMPLIED WARRANTY (OR CONDITION) MAY LAST, SO THE LIMITATIONDESCRIBED ABOVE MAY NOT APPLY TO YOU.

WHAT IS COVERED BY THIS WARRANTY?

Koloni Inc. 158 Touhy Ct. Des Plaines, IL60018. (“Koloni”) warrants the Koloni hardware product (“Koloni Product”)against defects in materials and workmanship when used normally, excludingnormal wear and tear for a period of ONE (1) YEAR from the date of originalpurchase ("Warranty Period").

WHAT IS NOT COVERED BY THIS WARRANTY?

This Warranty does not apply to any non-Kolonihardware products or any software, even if packaged or sold with Kolonihardware. Manufacturers, suppliers, or publishers, other than Koloni, mayprovide their own warranties to you – please contact them for furtherinformation. Software distributed by Koloni with or without the Koloni brand(including, but not limited to system software) is not covered by thisWarranty. Please refer to the licensing agreement accompanying the software fordetails of your rights with respect to its use. Koloni does not warrant thatthe operation of the Koloni Product will be uninterrupted or error-free. Koloniis not responsible for damage arising from failure to follow instructionsrelating to the Koloni Product’s use.

ThisWarranty does not apply: (a) to batteries that diminish over time, unlessfailure has occurred due to a defect in materials or workmanship; (b) tocosmetic damage, including but not limited to scratches, dents and brokenplastic unless failure has occurred due to a defect in materials orworkmanship; (c) to damage caused by use with a third party component; (d) todamage caused by accident, abuse, misuse, fire, unauthorized repairs,unauthorized usage or other external cause; (e) to damage caused by operatingthe Koloni Product outside Koloni’s acceptable usage guidelines; (f) to damagecaused by service (including upgrades and expansions) performed by anyone whois not a representative of Koloni; (g) to an Koloni Product that has beenmodified to alter functionality or capability without the written permission ofKoloni; (h) to wear and tear parts; (i) if any identifying number has beenremoved or defaced from the Koloni Product; or (j) if Koloni receivesinformation from relevant public authorities that the product has been stolen.

 

YOUR RESPONSIBILITIES

IF YOUR KOLONI PRODUCT IS CAPABLE OFSTORING SOFTWARE PROGRAMS, DATA AND OTHER INFORMATION, YOU SHOULD MAKE PERIODICBACKUP COPIES OF THE INFORMATION CONTAINED ON THE STORAGE MEDIA TO PROTECT THECONTENTS AND AS A PRECAUTION AGAINST POSSIBLE OPERATIONAL FAILURES.

Before receiving warranty service, Kolonior its agents may require that you furnish proof of purchase details.

WHAT WILL KOLONI DO IN THE EVENT THEWARRANTY IS BREACHED?

If during the Warranty Period you submit aclaim to Koloni this warranty, Koloni will, at its option:

(i) repair the Koloni Product using new orpreviously used Koloni parts, or

(ii) replace the Koloni Product with areplacement product of the same model or similar model that is new or comprisedof new and/or previously used Koloni parts and has been,

HOW TO OBTAIN WARRANTY SERVICE?

WARRANTY SERVICE OPTIONS

Koloni will provide warranty servicethrough one or more of the following option:

(i) Mail-in service. If Koloni determinesthat your Koloni Product is eligible for mail-in service, Koloni will send you shippinginstruction. Instructions may be sent to you via email or in hard copy with thenew packaging material. Koloni will pay for shipping from our facility afterwarranty service is provided.

(a) Service where Koloni requires return ofthe replaced Koloni Product or part. Koloni may require a credit cardauthorization as security for the retail price of the replacement KoloniProduct or part and applicable shipping costs. If you are unable to providecredit card authorization, DIY parts service may not be available to you and Koloniwill offer alternative arrangements for service. Koloni will ship a replacementKoloni Product or part to you with installation instructions, if applicable,and any requirements for the return of the replaced Koloni Product or part. Ifyou follow the instructions, Koloni will cancel the credit card authorization,so you will not be charged for the Koloni Product or part and shipping to andfrom your location. If you fail to return the replaced Koloni Product or partas instructed or return a replaced product or part that is ineligible forservice, Koloni will charge your credit card for the authorized amount.

Koloni reserves the right to change themethod by which Koloni may provide warranty service to you, and your KoloniProduct’s eligibility to receive a particular method of service. Service willbe limited to the options available in the country where service is requested.Service options, parts availability and response times may vary according tocountry. Koloni may use Koloni Products or replacement parts for service thatare sourced from a country that is different from the country from which the KoloniProduct or original parts were sourced. You may be responsible for shipping andhandling charges if the Koloni Product cannot be serviced in the country it isin. If you seek service in a country that is not the country of purchase, youwill comply with all applicable import and export laws and regulations and beresponsible for all custom duties, V.A.T. and other associated taxes andcharges. For international service, Koloni may repair or replace KoloniProducts and parts with comparable Koloni Products and parts that comply withlocal standards.

LIMITATION OF LIABILITY

EXCEPT AS PROVIDED IN THIS WARRANTY AND TOTHE MAXIMUM EXTENT PERMITTED BY LAW, KOLONI IS NOT RESPONSIBLE FOR DIRECT,SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES RESULTING FROM ANY BREACH OFWARRANTY OR CONDITION, OR UNDER ANY OTHER LEGAL THEORY, INCLUDING BUT NOTLIMITED TO LOSS OF USE; LOSS OF REVENUE; LOSS OF ACTUAL OR ANTICIPATED PROFITS(INCLUDING LOSS OF PROFITS ON CONTRACTS); LOSS OF THE USE OF MONEY; LOSS OFANTICIPATED SAVINGS; LOSS OF BUSINESS; LOSS OF OPPORTUNITY; LOSS OF GOODWILL;LOSS OF REPUTATION; LOSS OF, DAMAGE TO, COMPROMISE OR CORRUPTION OF DATA; ORANY INDIRECT OR CONSEQUENTIAL LOSS OR DAMAGE HOWSOEVER CAUSED INCLUDING THEREPLACEMENT OF EQUIPMENT AND PROPERTY, ANY COSTS OF RECOVERING, PROGRAMMING, ORREPRODUCING ANY PROGRAM OR DATA STORED IN OR USED WITH THE KOLONI PRODUCT ORANY FAILURE TO MAINTAIN THE CONFIDENTIALITY OF INFORMATION STORED IN THE KOLONIPRODUCT.

THE FOREGOING LIMITATION SHALL NOT APPLY TODEATH OR PERSONAL INJURY CLAIMS, OR ANY STATUTORY LIABILITY FOR INTENTIONAL ANDGROSS NEGLIGENT ACTS AND/OR OMISSIONS. KOLONI DISCLAIMS ANY REPRESENTATION THATIT WILL BE ABLE TO REPAIR ANY KOLONI PRODUCT UNDER THIS WARRANTY OR REPLACE THEKOLONI PRODUCT WITHOUT RISK TO OR LOSS OF INFORMATION STORED ON THE KOLONIPRODUCT.

SOME STATES (COUNTRIES AND PROVINCES) DONOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES,SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

GENERAL

No Koloni reseller, agent, or employee isauthorized to make any modification, extension, or addition to this Warranty.If any term is held to be illegal or unenforceable, the legality orenforceability of the remaining terms shall not be affected or impaired. ThisWarranty is governed by and construed under the laws of the country in whichthe Koloni Product purchase took place. Koloni or its successor in title is thewarrantor under this Warranty.
